Cannabis Laws in Malta

A plain-language overview of Malta's adult non-medical cannabis framework.

Important: Malta has partially decriminalised specific cannabis activities for adults. It has not created an unrestricted commercial cannabis market.

What adults may do

Possession

Official ARUC guidance describes possession of up to 7 grams in public and up to 50 grams of dried cannabis at home as partially decriminalised for adults.

Home cultivation

Adults may cultivate up to four cannabis plants per household for personal use. Plants must not be visible to third parties.

Association membership

Adults who are residents of Malta may apply to join one licensed Cannabis Harm Reduction Association. Membership is not available to tourists.

Cannabis seeds

ARUC lists importing cannabis seeds for personal use among the partially decriminalised activities. Importing cannabis itself remains prohibited.

Activities that remain restricted

  • Consuming cannabis in public can carry a fine.
  • Consuming cannabis in the presence of minors can carry a fine.
  • Growing plants where they are visible to third parties can carry a fine.
  • Sharing or selling cannabis to another person remains prohibited.
  • Importing or exporting cannabis, other than permitted personal-use seeds, remains prohibited.
  • Driving or operating heavy machinery under the influence remains prohibited.

Quantity limits matter

ARUC guidance states that possessing between 7 and 28 grams in public is depenalised and may carry a fine. Possessing more than 28 grams in public or more than 50 grams at home may be a criminal offence. Circumstances and current legislation can affect how rules apply.
